TESBL Corporation and its subsidiaries respect the privacy of our customers, business partners, and other visitors to our websites who may choose to provide personal information. We recognize the need for appropriate protections and management of personal information that you provide to us. This Privacy Statement will assist you to understand what types of information we may collect, how that information may be used, and with whom the information may be shared.

Scope

This Privacy Statement applies to information collected by TESBL through TESBL websites that display or link to this statement. Information we may process about clients of our customers is dealt with separately in the section entitled "Personal Information of our Customer's Clients" below.

 

Safe Harbor Compliance  Program

TESBL  is working  to prove compliance with  with the U.S.-E.U. Safe Harbor Framework and the U.S.-Swiss Safe Harbor Framework ("Safe Harbor") as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from the European Union, the European Economic Area, and Switzerland. TESBL is trying to get certification that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access and enforcement. What Personal Information does TESBL Collect?

On TESBL websites you can order products or services, register products, request information, subscribe to marketing or support materials, download software, enter a contest, apply for a job, respond to promotional campaigns, or register to a secure extranet site to obtain access to product information, support, services and training. TESBL will collect personal information from you for these purposes. Personal information for purposes of this Privacy Statement is information that identifies or can identify a specific individual. TESBL may collect information about individuals such as their name, address, telephone number or email address, user IDs and passwords, billing and transaction information, credit card or other financial information, and contact preferences. Personal information collected online may be supplemented with information you provide to TESBL through other TESBL services, as well as other sources such as trade shows or seminars, as well as other data appending methods.

TESBL does not collect personal information when you visit TESBL's websites unless you choose to provide it to TESBL.

How does TESBL use Personal Information?

TESBL will use personal information to provide customers and business partners with information and services and to help us better understand your needs and interests. Specifically, we use your information to welcome you, to help you complete a transaction or order, to deliver products or services to you, to bill you for products or services you purchased, and to provide ongoing service and support. Some of TESBL's websites provide on-line newsgroups, chat forums and blogs for our users. Any information that you disclose in these forums becomes public information, which could be read, collected or used by other users to send you unsolicited messages. You should exercise caution when deciding to disclose your personal information. Some TESBL websites also provide for "Live Chat" wherein TESBL personnel can monitor the user's areas of interest in the website and engage in instant messaging with the user to provide additional information or answer any questions. By posting in our newsgroups and using "Live Chat" you expressly consent to these uses of your information. We are not responsible for the personal information you choose to submit in these forums. For testimonials, we provide a choice as to whether a user posts his or her personal information along with the testimonial.

In accordance with applicable law, personal information collected on TESBL websites may be transferred, stored and processed in the United States or any other country in which TESBL or its affiliates, subsidiaries or service providers maintain facilities, even if the level of data privacy required is less than that required by the European Union or under Safe Harbor . By entering your personal information, you consent to worldwide processing of your personal information.

In addition, we may use aggregate demographic information to improve our websites, but that information is not personally identifiable.

With whom does TESBL Share Personal Information?

TESBL contracts with third party service providers and suppliers (including distributors and resellers) to deliver certain products, services and customer solutions. Examples of such services provided on our behalf are the delivery of mailings, hosting websites, processing transactions, and planning events. TESBL may share personal information with its service providers and suppliers to the extent needed to deliver the service or respond to requests for information on products or services or otherwise support the customers' business needs. We may also disclose personal information and the content of communications in order to: (a) comply with the law or respond to lawful requests or legal process; or (b) act in good faith to protect the rights or property of our business, employees, suppliers or customers.

Some TESBL services may be co-branded and offered in conjunction with another company. If you register for or use such services, both TESBL and the other company may receive information collected in conjunction with the co-branded services.

Unless permitted by relevant laws, or you have provided consent, TESBL will not share, sell, trade or lease your personal information to others, except as provided in this Privacy Statement.

Choice and Access

The decision to provide personal information through this website is voluntary. If you do not provide the personal information requested, however, you may not be able to proceed with the activity or receive the benefit for which the personal information is being requested.

You can always unsubscribe or choose not to receive promotional information from us by following the specific instructions in the email you receive or by notifying us via the appropriate method below depending on which site is at issue. It may take a reasonable period of time to process your request, no longer than 30 days for direct mail and telephone promotions and 10 business days for e-mail promotions. We will retain your personal information for as long as your account is active or as needed to provide you services. We will retain, use and disclose your information as necessary to comply with our legal, ethical or document retention obligations, resolve disputes, and enforce our agreements, and any request to delete personal information is subject to these obligations.

Security of Personal Information

TESBL is committed to taking reasonable efforts to secure the personal information you choose to provide us. To protect the privacy of any personal information you may have provided, TESBL employs Internet firewalls, intrusion detection, anti-virus protection, and network monitoring, and, where appropriate and required by applicable law, Transport Layer Security (TLS) or similarly encrypted browsers. Cookies, Advertising and Referrals

TESBL may collect and/or log Internet Protocol addresses, Internet domain names, the web browser and operating system used to access the TESBL website, the files visited, the time spent in each file, and the time and date of each visit. TESBL may collect these through the use of log files and web beacons.

TESBL also uses cookies on some of its websites. Cookies are files that can be sent from a website via your browser to be placed on your computer's hard drive. The type of information we collect includes the pages visited, navigation patterns, etc. This information helps us learn things such as what product information is of most interest to our customers, and what kinds of offers our customers like to see. These third party tracking devices only collect data in the aggregate. Although the vendor logs the information coming from our site on our behalf, TESBL controls how that data may and may not be used. Websites of TESBL subsidiaries or divisions may use similar tracking tools for similar internal business purposes only. Social Media (Features) and Widgets:

Our Web sites may include social media features, such as the Facebook “Like” button, and widgets, such as the ”share this” button. These features may collect your IP address and the page you are visiting on our site, and also may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our site. Your interactions with these features are governed by the privacy policy of the company providing it.

If you choose to use our referral service to tell a friend about a page on TESBL.com, we will ask you for your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site. TESBL does not store this information, except to the extent permitted by law.

Links to Non-TESBL Websites and Third Parties

The TESBL websites may provide links to third-party websites for your convenience and information. If you access those links, you will leave the TESBL website. TESBL does not control those sites or their privacy practices, which may differ from TESBL's. We do not endorse or make any representations about third party websites. Personal Information of our Customers' Clients

When we provide services to our customers, in some instances we process personal information about their clients ("Client Information") on their behalf. In these situations it is our customers rather than we who decide the reasons for which the Client Information will be processed. For details of how the Client Information will be used and protected, and details of how to access or correct the information, please refer to the privacy policy of the TESBL customer to whom you submitted your personal information.
Use of web beacons
We may also use web beacon technologies to better tailor the site to provide better customer service. A web beacon is a single pixel transparent image that allows a web site to count users who have visited that page or access certain cookies. These web beacons may be placed on specific pages across this web site. When a visitor accesses these pages, an anonymous notice of that visit is generated which may be processed by us or by our vendors. These web beacons work in conjunction with cookies.  TESBL will review and update this Statement periodically, and will note the date of its most recent revision above. If we make material changes to this Statement, we will notify you either by prominently posting a notice of such changes prior to implementing the changes or by directly sending you a notification. Should we undergo any sort of corporate reorganisation in the future, you agree that we may provide your information to the resulting entity in which case we will follow these Change procedures.
